So we got nothing in court

justmakingthebest's picture

Nothing bad, nothing good... Just nothing.

The judge told BM's lawyer to draw up a final agreement... They didn't. So now he told our lawyer to. So that is it. The end. No Christmas break. Nothing about spring break or summer break or anything. Just write what they discussed in court in APRIL. Which was: sure, dad can have spring break and "part of summer".

Our lawyer said he is going to get it done asap and then file an immediate motion to modify. Yay... Merry Christmas to us.

Sorry, but I'm not surprised. Last time we had a modification the judge gave BM money she didn't even ask for. Now we have to pay more money out to get it changed. Blah. Six more years, six more years.

Yep. BM's lawyer didn't show so the judge told our lawyer to do what he told her lawyer to do in April and that is it.

One would think... but in po-dunk midwest, I guess not...

I thought for sure there was going to be a bench warrant, she was going to lose. She was going to have to pay the flight cost. All of it! I was so sure a judge was going to see past the bullshit!

I live in po-dunk midwest. Once, BM's attorney didn't show up and the Judge made BM represent herself.

I can't believe you guys don't have any recourse for what the Judge did.

Are you sure this isn't upstate NY? Our court date is the 8th of January. Should be interesting seeing the Girhippo voluntarily quit her well paying CPS job to be a waitress at a casino--Chef's wages have gone down drastically as well.

We're hoping that the magistrate will constructively emancipate SD19 but odds are not good on that one. Even though Chef hasn't laid eyes on her for coming up on 10 years. And she's refused reunification attempts as well as revealing her college grades.

We're also hoping to lay groundwork for college requirements--not just year upon year of academic probation, switching majors and failing out of remedial high school courses in community college--all the while CS still flows to the mothership.

Also a downward mod for YSS stb 15 would be nice. He'll be 15 by the time we go to court. CS goes to 21 here. I don't even want to THINK about all the money Chef has poured down the rat hole for the past thirteen years.

Holy crap :jawdrop:

Was there a significant change of circumstances from the time the CO was written? If there was no change then I can see why the judge didn't change anything in the CO.

My ex husbands ex wife (his second wife) only gave her ex husband (her 1st husband and her childrens father) 2 weeks in the summer. That's all the visitation he got. Crappy custody order just like your DH's.

In 5 years he has never been able to get her to agree to a CO. This is the most insane custody situation.

So now your husband has to pay for his lawyer to draw up the agreement because BM's lawyer didn't do it? Crappy.
