HELP - have a question and can't wait to talk to the lawyer because she's in trial
Temp custody paperwork was signed before BM moved out of state and SS came to live with us with holidays and vacations with his mom. When the final paperwork came to be signed she threw a fit and wouldn't sign it. Wanted him to come down every month (isn't possible).
She was told that if she didn't agree with the custody arrangement that she needed to repsond in writing. She sent our lawyer a fax of the custody paperwork with written changes that she wanted and we didn't agree with them.
It's 3 months later and we're going to court next week to file for default because she never filed the response through the courts.
What I'm wondering is that she states that the fax she sent to our lawyer was a response and all she needed to do and I thought she needed to response directly to the court and file her response. Who's right?

If it's not filed with the courts, it doesn't count.

but BM is always so sure that she's right that she had me questioning it. I should know better by now, she's never been right before just thinks she is

When it comes to BM's like this, always remember The Right Guard Rule.
Never let them see you sweat!
And by the way, I have a come back for whenever my skids' mom thinks she's one-upping me and I know she's not... I just say, "Really? Well, good luck with that." She's never sure what to make of it!

Right Guard Rule - LOL
That is so true! She's always bad mouthing me and saying how she's going to do this and that legally (never seen it happen yet) and I never say anything because all she's doing is giving us more amo to use when he file for full custody.
