Trying to decide if we should do a custody evaulation

mmm1's picture

BM is refusing phone contact, as well as refusing to allow doctors to talk to my husband about the chidlrens medical. Also visitation has been denied at times. Kids have missed 10 days of school so far this year. SD has been seen by OBGYN and courts asked why and BM said it wasnt confidential and no bodys buisness, even my husbands.
Refuses to follow any of the court orders. Last court order BM filed for all court cases to be moved to her state where she now resides with reasons that she doesnt feel Utah courts were being fair to her.

She asked to have it moved. We are fighting it. We are contesting but we still have to hire an attorney in the state of Wyoming to fight her trying to move it.
And yes they have JLC. BM simply wants us to pay child support and go away.

Fight the change of venue. Keep the case in the jurisdiction where your DH lives. This definitely gives him some additional stroke in this situation.

DH also needs to have his attorney subpoena all of the medical records for the kids and I would also initiate a custody evaluation or at least a wellness check by CPS.

To quote the bard, "There is something rotten in the state of Denmark". The only way to find out is to get the experts involved.

All IMHO of course.

Good luck and best regards,

I'd get the court involved. I'd also do a CPS call. Am I correct when I say that BM moved the kids from Utah to Wyoming?

Yes. She moved 10 days after thier divorce got remarried because she was 8 months pregnant with the new dads baby.
