Commission only job & Child Support!!! Help!
Well, it never seems to end nowadays...so, what's worse than being laid off? Being moved to a commission ONLY department, which means you have not lost your job, thus people still assume you can make the same amount of money...
My husband has just been told he and the entire team at his job will be moved to a commission only division. Yes, lovely. That means, that he may have to be spending money out of his own pocket for the darn company and possibly not even making it up in commissions...not a single penny in salary...but of course, I am sure the idiots at CS will still want their piece of the pie...oh, sorry, not a piece of the pie, the same piece they used to get...sigh...In addition, we believe that he will also lose his health insurance, which means our entire family will be without insurance, including our autistic son...and well, there's not much he can do because his option would be NOT to accept the transfer, which would in the eyes of the idiots of CS be the same as "quitting"...I am a nervous wreck and I am trying not to show it. Has anyone here been through this mess with the morons at the CS office? Any luck in getting CS reduced? At this point I actually have a temporary contracted job, and well, I guess my first step will be to take ALL my money out of our joint account because I'll be damned if CS or the ex or loser kid will get one dime from MY money for them...I know that if it's in a joint account, they could garnish my money...and I am not taking that risk. And I don't want to hear "well, he needs to support his loser kid too" because he won't be supporting OUR son unless he makes commission, and by the way, his pathetic loser kid is now 17, in 9th grade and has missed 42 days of school in this semester :sick: But of course, for now, he must continue to pay for the loser...

That's the thing. If you are NCP bioMOM, they will grant a downward mod. If you happen to be an NCP bioDAD then that's a different story altogether. There's a huge double standard in the system.

Where do you live? If you are in the U.S. and live in NY, CA or MA, they are big fans in INPUTING income. So if biodad gets laid off even and unemployment stops, the courts like to keep the CS high and will not lower it based what he is making; instead they'll "UP" it on what he "could" be earning. Which puts him into instant arrears. Which then puts him in danger of "debtor's prison" loss of professional, driving licenses, etc.
For every dollar of CS collected, most states collect matching "incentive" funds to collect more from the Feds, so no incentive to grant a downward mod. The three states I"ve mentioned are the worst of the worst for NCP biodads. If you don't live in one of those three you may have a chance at getting a downward mod.
I feel your pain. Biodad I live with is actually OVERPAYING to keep the BM out of his hair. He brings home a whopping $200 a week after taxes and CS. Needless to say I'm the breadwinner. Ask me why again I won't get married to him when CS goes to 21 and beyond here in NYS.
