In court today I laughed.

At my Exes face, in front of the DOR lawyer.

So I got a call last week from DOR/CSE telling me that Ex had filed back in August to have our CS order modified due to job loss. Dude can't keep a job for more than a year ever.

Oh well it's one of my aftercare only days at work so it's not like I'd be missing out on a whole bunch of money to go. I agree, despite not being served. Show up, do the paperwork and the waiting game. I guess Ex didn't want to pay to file so he file through CSE instead of just through the court house. An attorney for DOR/CSE comes out, calls both of us over and shows us the new support amount. It's really only about $20 less, I mean really, wtf was the point? I thought he had NO INCOME and that's why we were playing this game, not that he was getting unemployment benefits. Though I see he is looking quite shocked by this change as well..

Ex: "Where did you get that figure?? I don't have any income."
DOR: You wrote down that you are receiving $$$ from unemployment.. is this incorrect?
Ex: Oh, I didn't realize unemployment counted as income.
Kifire: *Laughter* You pay taxes on it don't you?! It's income.

He went on to dispute the amount he has to pay so we got to wait around some more to go in front of a judge. He said it again! to the judge!! Unemployment isn't income!! She asked him what her would consider a fair amount, he say's $50/week. She asks me about it. I give off a spiel I researched about the guidelines having provisions for NCPs who do less than 10% visitation, meaning I felt I was entitled to a deviation from the guidelines and more CS than the flat amount since he does not take on the burden of ANY child related cost other than CS - No copays, no fundraisers, no clothes, no food, no transportation because he hasn't seen the child since 2011.

We were dismissed and told they would come up with a decision and mail it to us. Lol. I don't rely on it anyway because he pays it only sporadically but if he's going to dispute the black and white guidelines I'm not going to just let him dictate what his CS should be.

In my state they can and will garnish unemployment.

Uberskank was in arrears. Quit her job and assumed she wouldn't have to pay any CS or for the arrears.

Imagine her surprise when not only was CS garnish, but a percentage of the arrears. She screeched LOUDLY. And demanded H tell the state to do something about it.

He reminded her when she was ordered to pay CS that he offered to let her pay him directly and she waved him off and told him to put it through the state. It was her decision and not his fault.

She screeched some more and he walked away.

One of his best days with her.

I didn't have to tell her that, the DOR attorney did. He said "currently the plaintiff is overpaid by $110 but there is a history of non-payment"

As far as I know WTF they have been because I have actually been getting all of my CS payments on time for the last few months, he must have lost his job in the summer. It's when he's working I have trouble... he tends to get jobs by having friends pull strings. but unemployment runs through the state, he has no friends there.
