Can anyone help me?
Im married and we have two small kids, a 5yr old and a 3yr old. My husband has a 10yr old that does not live with us, but he gets her every other weekend, and he pays child support for her. My husbands ex is living with someone and they have a 2yr old son. She and the boyfriend make good money, they even bought a house (we live in an apartment). My question is can my husband re open his child support case because the judge order him to pay a big amount and did not take into consideration that he has 2 other small kids and a wife to support? Im afraid that he will open the case and it will only be worse for us, what can we do?

In alot of states, judges
In alot of states, judges usually say that since she was first kid, she still gets the support regardless of how many kids he has after that, they usually wont take into consideration other children or wives. If he has had a job change, less money or if she has an increase in money (usually wont take into consideration the b/fs income) then maybe he should re-open the case.

We actualy already tryed modifying the CS order in the past and they only made him pay more because he had gotten a raise, but the part that confused me was that when the judge was ordering him to pay more he also said "because you do have 2 other small kids to taka care of you can go to a facilitator and if she comes up with less bring me the paper and i will reduce the cs order" that lead me to think that maybe we could lower it? what do you guys think?

I live in Ca and yes the will reduce CS..When BM tried to get more from DH after we got married I filed for a mod and it went down from 1200 to a little less then 600.

I'm a little afraid to try and modify the CS again because when we first did we ended up paying $300 more do you think if we buy a house and tell the judge that we have 2 kids it will lower?

I live in Cali also and in Cali its first family first so no they will not care that you and hubby bought a house or have two kids together. They look at it like you knew what you were getting into and you knew that he had this child to care for and you made the choice to have more and buy a house. How long has it been since you tried to modify it last?

we live in ali too and the last time we tryed was about a yr ago but we ended up paying more but the judge told my hubby that he can go to a facilitator and if she calculates that it should be less because of our two kids then he can go back and the judge would lower it but we are scared to go and it not wk out like we plan
