Fathers Day Weekend

So, i just found out the ex will have my daughter out of the state for Fathers Day weekend, and she will not get to spend it with me and her step mom as is dictated in the divorce decree.

Feeing a little helpless right now, as i was not asked about this.

History has shown me that calling the police or a lawyer does no good in these situations, but it just isnt right.

Does anyone have any advice for someone like me who is at his wit's end?

Document EVERYTHING on ex. And your lawyer has to be well versed in fathers rights, and has to be a PITBULL. So many of these lawyers are Chihuahuas who can't stand up to the bigger dogs that are the bio mom's attorneys. If your lawyer isn't a pitbull, it's time to find a new one. Best of luck.

File a report if she denines visitation (MOST CO's give Dad's fathers day and moms mothers day)

If you want to be proactive have an attorney send a letter stating on June 17th She is to give SD to you at ___ time, if it does not occur legal action will be taken. If you want the time you have to be willing to fight for it.

These hateful BM types do that on purpose, to hurt the dad! it has happened to us too, really every year. So we just celebrate when you do see the child.

Or really too I started telling my DH happy fathers day and he gets to get something he really wants - that really helps me on these 'holidays' - for me it is my birthday I always feel a little down so get myself a treat. Try it!!

She is in violation of a court order right? That is a criminal act and any attorney you asked about would have told you this.

If you wish to pursue this you take a disinterested third party with you and follow the normal procedure to obtain custody of the child for the day. I.e. you go and pick her up at her home or you wait for your ex to deliver her.

If the girl isn't produced - no one at home - or no one appears at your door in a timely manner then she is in violation. You then ask your attorney (or you can act as your own) to file a petition to find your ex in violation of the order.

But first any good attorney can write your ex a letter explaining all of this and threaten her if she violates. Usually that is all it takes as her attorney would have to advise her the same.
