X threatens court

I thought everything was good until this last weekend. My dh has been driving a distance of 60miles one way on Saturday and then returning him home on Saturday (4 trips) EOW to pick up his 16 year old. He has done this for YEARS because he did it for his older two also. He was divorced for years. Well, he was in a real (I mean REAL) financial crunch and since his boy was older started picking him up on Saturday and spending the entire day with him close to the boy's home, spending real quality time with him. 8 hours of movies, lunch, tennis, golf & visiting with his older son and then dropping him off at home.

Well---the s... hit the fan & his X realized that she would no longer have Saturday night "free" she called my dh and told him she hadn't agreed to the change in visitation schedule & wants to take him to court because he isn't taking the boy for overnighters. She could care less about his financial problems (HIS CAR BROKE DOWN ON THREE DIFFERENT OCCASIONS IN THE LONG TRECK---FOR STARTERS)anyway-----the b thinks the judge will order overnighters! I don't think sooooo! She is in for a surprise!!!!!!

Has anyone ever heard of a judge doing this???

The judge is not going to order him to exercise his parenting time. It is his time to take or not to take.

Now, what I would do if I were you is have the judge make it so that one drops off and one picks up or have them meet halfway to make this easier on your DH.

File a counter motion to modify parenting time and have this put in there and then the judge could then clearly see that it is just financially hard with gas right now and with repairs to boot and it isn't that he doesn't want to see his son but he is the only one doing all the driving. I wouldn't really file it but have it ready for court to present as the solution.

Just think...what would the BM do then?

She is all about the money & her free time. She has never put that boy in a sports program! It takes her time!!! She has bullied my husband far toooo long.

My parents went thru this when I was younger because my mom & stepdad moved an hour away from my dad and at the time he was always the one to pick up & drop off. So he took her back to court after the move & the judge ordered that since she moved SHE had to start doing ALL the driving. Well she didn't like that, but luckily my dad was nice enough to split it with her, even though when he was doing all the driving she never offered to split it with him.
