Alimony in New Jersey

My bf ex wife has a boyfriend now for two months and supposedly he is moving in with her into her rented apartment and then they plan on buying a house in about a year. Can we have the alimony lowered because she has someone living with her now that is her boyfriend?

Thank you so much for answering me. This doesn't sound easy but they are planning on buying a house in another state and he doesn't have a job so it seems like we are supporting both of them Smile

Why doesn't he have a job? He can also modify due to the change in that circumstance!

Do some research online, that are related to your state...with case law, it's a bit easier to find out what would happen than from reading the actual laws...although obviously, you have to read the laws, sometimes there are loopholes and so you might want to read case law also...

PS - I am NOT a lawyer or giving any lawyer advice...just sending you some sites I found...

Again, thank you all so much. This site is awesome. I just get so mad that we have custody of the kids, we don't get child support from her and we pay for it ALL, i mean all of it and she gets a boyfriend and he doesn't have a job got layed off or something and they plan on buying a big house within a year but now he is moving in with her. It makes me soo mad. Again, we have the kids and to me that is all that matters but she now has a job and we asked to pay for 1/2 her son's driving school and she sent a letter stating that is not her obligation because we would credit from putting him on our insurance. She needs help really.

Wow, doesn't the alimony she receives count as income for Child Support purposes? I can't see why it wouldn't, since I know in some states even CHILD SUPPORT received by the obligor for other kids can be counted as income...

make sure you get proof that they are living together. She may deny it in court and BF will be looked at for proof.

If she co habitates alimony stops, if his hours are reduced the CS should be reduced as well.

Doesn't stop automatically in NJ. It can be reduced or terminated if they can prove she benefits financially by the co-habitation.

That sucks. How could she not benefit in some way? But proving it is the hard part.

I think the OP mentioned that said bf doesn't have a job. WTF, so this poor guy's alimony is supporting his x and her lazy ass boyfriend.
