What to do when BM
FDH AND BM just made a new visitation order (they didn't have one before)...they verbally agreed in mediation that BM gets the kids the day before their birthday and takes them to school on their birthday. FDH time is the day of birthday after school... BM agreed to this in mediation...court papers are being drawn up and legalized...
Ss10 birthday is tuesday. She informed FDH just today that "her version" if the paper work she just signed says she gets them the day of the birthday and that is what she is following... FDH has not seen this paper, has not signed it...
But he does have aletter from her lawyer dated end of february supporting his side.
BM is planning to pick up the kids tuesday, FDH was planning on her picking them up tomorrow after school....
He is contacting his lawyer first thing tomorrow.... But what can he do???
Verbally they agreed she gets them the day before... FDH has never seen or signed any paper work other than ones that supported her getting them the day before and him getting them the day of....

Yes he has primary custody.... BM gets visitation...
Their previous order stated
Their previous order stated more our less that they would be adults about it, and agree rl the times of visitation verbally,.... Within the last year BM has been extremely difficult, trying to take them for all of christmas break, lying to the kids that dad didn't want to pick them up and lying to FDH that the kids wanted to stay longer than the adults had agreed upon,... Trying to take the kids two years in a row on EVERY HOLIDAY christmas eve, christmas day, thanksgiving......
So FDH SAID ENOUGH THIS ISN'T WORKING and took her back to court....with a her lawyer and his lawyer they agreed on a schedule,.... This schedule is still in the process of being signed by both parties and the judge, it isn't legal yet we know,... But everything was agreed upon.....
What FDH is trying to figure out is what can he do if BM shows up at school and takes them tomorrow when that is not what they agreed on and not what they did for another kids birthday less than one month ago...
If he has primary custody
If he has primary custody (and paperwork to BACK that assertion), he can go to the school, give them a copy and tell them that BM is not allowed to pick the kids up from school on x day.
