FINALLY!!!
Took just over SIX MONTHS with two court appearances to recognize (no dispute from the BM) that OSS has been emancipated. OH yes, it was supposed to be a SHHHHHH secret that OSS, just before age 18, moved out of custodial BM's house last August. Oh yes and the BM was ANGRY that Chef knew about this.
Otherwise, she would have just kept silent, collected daycare expenses that she hadn't been using for well over five years (for the younger 2, now aged 12 and 16.5) and kept the CS rolling in for absent OSS. Yes, CS goes to 21 mandatory here in NYS, but you still have to go to court to get it stopped even after skid is emancipated/aged out.
And yes, the ONLY good thing about Chef's mediation agreement was that it said if skid moves out of BM's house, than it is considered an emancipation event should skid not move in with non-custodial Chef. This only goes to prove that the mediation agreement they signed was merely a "serving suggestion" for the BM. She had totally broken that agreement so many times it would make your head spin. Withholding visitation, discouraging co-parenting, spying, stopping school records, keeping skid medical visits a secret, signing skids up for everything under the sun without consulting Chef. Chef was a VERY active "parent" albeit extreme Disney Dad the first six years but then started to drop the rope when he saw that the BM was conspiring to make phoney CPS reports against us (she's a CPS worker by trade in the next county over) AND would NOT allow him to have ANY say over his own children. We had no money to hold the BM in contempt after the massive CS voluntary overpayments.
The ONLY way Chef knew about the emancipation was me keeping a faux FB account in which I saw that the BM was proudly proclaiming all over FB that OSS had moved out to Chef's estranged brother's house.
She made no contest about not using daycare expenses for well over 5 years which were rolled into the hefty overpayment of CS and the fact that OSS had moved out (caught red handed)
The court order was filed on 10/22/14, settled on 2/13, took till 3/30 to get it signed by the new pro-GUBM magistrate who is taking over from the OLD pro-GUBM magistrate. AND another month (4/25) to get it stamped by the court. Unreal!
