Oh darn BM, that's too bad you don't get to make up your own rules. Have fun getting audited!

BM claimed the skids on her taxes although DH has primary custody and they are with us two-thirds of the time. So, I mailed our paper return yesterday with the kids on it and I know it's going to take like six months to get it sorted out, but BM is in for a nasty surprise and I can't WAIT!

I was so tempted to call her when I found out and tell her exactly how stupid and pathetically humorous she is and I was looking forward to the hell she is about to be living. I e-filed originally and it came back rejected with a message, "SSN for a qualifying child cannot be used on another taxpayer's return." I knew it was on! I'm so sick of that stupid c$nt thinking she can make up her own rules anytime she feels like it. It hurts my soul to think that my husband's kids are around such a lying, cheating whore at all and learning that it's okay to do as you please regardless of any little thing like laws, etc.

What really chaps me is that with this refund we were going to payoff everything we owed and be 100% debt-free. Now we're going to have a minimum of three more months of credit card interest to deal with. Even if the IRS makes her pay interest, it'll only be 6%, which is about half of what we're paying on the cc.

How can anyone be so fucking stupid? How can she honestly believe that this will not come back and bite her in the ass? Jeez, DH really found a moron from the shallow end of the gene pool to procreate with!

Not only that, but since BM is going to be up to her eyeballs in IRS debt AND hopefully repaying for welfare fraud (I'm hoping for jail, but whatever) our chances of seeing any CS out of her in the next zillion years are pretty slim. On the good side, I don't think she'll be able to afford taking us to court for custody of the skids anytime soon, like I know she's planning to in May since oldest SD is now 12. Muwahahah }:) You made your bed, bitch!

You've burst nothing with your misinformation. Yes, the IRS will give her the money, but they'll also see that she pays it back. We don't have to wait for her to pay it back to get ours. She'll probably also lose the chance to claim EIC for years because now it will have been disallowed for more than a math or clerical error.

IRS.gov is an excellent website where you can find out more. Or talk to any legitimate tax preparer and by legitimate I don't mean someone who took a one week class from HR block though even those people should be able to tell you the four tiebreakers for claiming a qualifying child.

A non custodial parent can only take the deduction if they have a completed form 8332. The instructions for 1040 spell it all out.

Yeah... It is a court issue. Per court my DH claims one of his kids. BM can claim the other... But doesn't because she is a piece of shit and doesn't even work.

My DF's tried that last year & the IRS told him that the kids had to LIVE WITH HER for 6 months & 1 day to qualify HER to claim them...she got bitten HARD by the IRS within 6 months...my brother had the same situation with his kids BM...same story from the IRS there too...

What a hag. Our BM gets to claim the 1 remaining skid. She's stupid, if we claimed him she would get more money back since they added the extra $17K to arrears when she asked for more money and they made it RETRO to the date of filing. I hate that C&nt for that.

Why can't my DH see that I'm NOT the greedy one!!

I think that's the only reason she didn't claim them last year. She thought she was going to get our refund anyway. Hehe, but what we did was wait to file. You have 3 years from the time the return is due to file if the IRS owes you a refund. We waited until DH's back CS was cleared up because he's had the kids for 3 years without her paying a dime.

As soon as we got the all clear from the AG's office, we filed our taxes for the last 3 years. Of course, she got zilch.

Check out my post (IRS Form 8332 Nightmare) we are going through the same thing. Once again we have to float bills until our refunds are figured out. But we have a contempt hearing in March

We STILL have not got DH's 8332 back even YET signed from BM as "promised" to pay off debts that fell on my DH instead of her name. It will not make a dent in the total but it was a start. I'm sure she is taking her sweet time returning it back to DH. (He even gave her a SASE to return it in.)

The whole 8332 thing is such a joke. Why in the world would the IRS make it so some dumb form has to be signed EVERY year? They should do something where a form could be generated by a court clerk or something based on the latest order. Ya know?

It is a joke. Our CO states that BM gets older skid and H gets younger. When SD turns 18, they are to alternate SS with H getting the first year.

We even so much as printed out and sent BM a 8332 with the "All future years" checked for SS (since the way the CO is set up, H will have SS the entire time). BM REFUSED to sign this form. She said she will sign a form each year.

So, we sent her however many copies of the 8332, filled out with each year just waiting for her little signature and to mail it to us. Yet, it is the last day of January and we have yet to receive it.

Oh, the CO also says that the form is to be completed and given to H "during the tax season." What the hell is tax season? Does that mean that we'd have to wait until April 15 to see if we need to file contempt against BM??

Thank goodness there are only a few years left of this dog and pony show!

as long as it's court ordered for your dh to claim them, hell will be upon her, LET her claim them and go spend all the refund, cause not only will YOU get the refund, she will have already blown her "refund" and they will garnish her wages if they have to to get it back...she WILL pay it back.

He doesn't have to be court ordered to claim them. He's the CP. They live with us. He's got the order saying that along with school records. When the IRS sees that both kids were claimed they'll send out an audit letter to us and to BM, to see who really has the right to claim them. We'll send our proof and she'll send jack shit. Slam mother effin' dunk.

Hehe, I think she got one of those pre-Christmas rapid refund loans, so the money was probably spent over a month ago. She's going to have HELL paying it back. It's horrible but this really does amuse me to no end.

my SO ex fiddled the child benefit and working family tax that you get in the UK saying her and my SO actually separated in late 2009, a whole 18 months after the actual split. as the claim was in joint names they chased him for half the debt till he pointed out that it went to her bank account, and that he had opened a new claim for wtc me.
plus the BM got done for benefit fraud for not declaring her lodgers, AND the fact her bf lived in the house.
dum dum dum.
The UK is good where you dont declare your kids AND you only have to file if you are self employed. our tax is determined at the beginning of hte financial year so much MUCH easier.
will miss it if we ever move back to canada. i hated doing my taxes each year.

In the US, tax season means free money for a large portion of the population with children. Low wages and kids = big bucks with "earned income credit"

Decent income and kids = free $$$ with "additional child tax credit"

It's so bizarre. So many people with children don't actually pay any taxes.
