QUESTION!!!
Ok, so I went back to stay at the house last night. I did a quick inventory of everything and found that he took my personal files. He took all my old tax return info, my birth certificate, my kids Social Security Cards, Their Birth Certs, all of my CS documents, my custody paperwork... everything!
I want to e-mail his mommy dearest and tell her that if my files are not magically back on my front porch when I get home from work I will file a civil suit against him and put a lien against his business for the cost of my time to replace everything. If he returns it, they will never have to hear from me again.
The police said that according to the protection order all it states is that he can't destroy my belongings, it doesn't say he couldn't take them, I have to file a civil suit to get them back.
What do y'all think?

Hmmm not sure if you tell them to do something (bring back files) and if they dont you will do something (civil suit) if that is considered threatening, etc????
I would be HEATED though. Why in the world would he take your PERSONAL files. That would creep me the f out. What a jerk.
What if I word it along the
What if I word it along the line of "the police have instructed me to file a civil suit unless you return them immediately"?
Yes if the police said that
Yes if the police said that then I would say that instead.
Agreed!
Agreed!
Um, theft is theft? Not
Um, theft is theft? Not civil, it's criminal. He can't claim that your old tax return info, your birth certificate, your kids' Social Security Cards, your kids' Birth Certs, all of your CS documents and your custody paperwork is even *partially* his. It's 100% yours. Period. Theft.
I'd call him and say this "The police have been notified of my missing property. You have until noon today to return it or I will file a report."
None of that is his. They
None of that is his. They aren't his children.
He was saying that he will do whatever he can to help my ex take my kids from me, I have a feeling this is about this threat.
Exactly ^^ I'm a retired cop.
Exactly
I'm a retired cop. I would have taken your theft report. Because it is theft.
The beautiful vase you bought on vacation? The bathroom rugs? The marital bed? All can be argued as jointly owned property - civil. But not your personal identity paperwork, or your children's. Theft. Criminal.
Thank you!
Thank you!

Yes^^^ Someone was using my SSN when I was a minor and we didn't learn about it until I went to open up my first bank account with the help of my mom being I was 16 years old at the time.
It was a mess getting it cleared up but we had no idea that someone was using my SSN. In your case, I'd worry that he might sell/give the SSN to someone. Take legal action and keep tabs on the personal information, he sounds like a complete jerk. Good luck.
