BM Not Eligible for Public Defender!! Tehe

So BM has a felony forgery charge against her right now (forged DH signature on a fianacial liability form at SS dentist office). Her lawyer that she had previously hired to represent her on all her cases (1 custody modification, 2 felonies, 3 misdemeanors, 3 traffic tickets) quit on her. Well her Forgery case is set for a hearing tomorrow so we checked online to see if it has been continued....she is the queen of having cases continued.....and there is a filing from the state public defenders office stating that she is not eligible for public defender services! hehe......wonder why? Because she doesnt have a job, any property, or any money that we know of. Cant wait to see what happens next!

She still has not paid the GAL as far as we know the remainder of her fee, and we are not sure at this point where BM is even living. She is an absolute mess! SS first softball game was last night and she did not go. Her dad was there and according to her dads girlfriend he was furious that she did not go......about 5 min after we left the ballfield BM called and told DH she didnt go because she had strep....uhhuh....sure. I bet her dad called her out on it and that was her split decision lie to cover up the fact she didnt go.

felony forgery in our state can mean jail time. So that would make her eligible, thats why we are wondering why she was deemed not eligible. The only thing we can think of is that she does have a trust that she has been hiding from everyone and they found it. And if she lied about it in the application that could be another criminal charge to add to the list.....hmmmmmm

However is she did in fact have a trust then why the hell has she not gotten her own place and paid the GAL??

It also could be that the Public Defender thinks there is a conflict in the case (as in they don't want to represent her anymore because she refuses to listen to their advice) and are assigning her case to the alternate public defender's office, if your city has one. Probably should wait and see.

Not paying the GAL winds up with jail time should the GAL pursue. My ex had to borrow $10,000 from a mutual friend last summer to avoid jail as he never paid the GAL against BM2!!! It has the same rules as CS, but judges are strict as otherwise no one would be a GAL! Ex always weasels out of these things at the last second.

Yeah i am sure she will appeal and get one appointed. I just thought it was interesting that she was denied. So we shall see. My DH is going to the hearing tomorrow to speak with the prosecutor and tell him enough with the delays. It has been over a year since he found out about her signing his signature to the form.

Sometimes applying for a public defender is like applying for disability, your usually always denied the first time you apply. Public defenders caseloads are always smaller then regular lawyers but still get too busy to take on too many cases. Judge may refer her to the public defender again and they may still take on her case. That's how it happens in my state anyways.
