i currently have a court date in may for custody, apparently my ex "did not receive his letter". I sent his mom a copy of my letter and told her to tell him to call the court house up here to find out. since she had to go to court anyway over a different matter she asked for advice to one of the people there. They said that its likely that my ex would need to come up here for the court date instead of doing it by phone as i was led to believe. my question is in a custody case is it necessary for both party's to be present in the court room or is it possible to do it by phone? I live in ohio he lives in puerto rico. I have looked online for rules regarding this but i have found nothing. so i'm asking here does anyone know??

By phone can be difficult, the line can be bad and the one calling or the court may not be able to hear what someone said. I think you have to be present or make a special request to the court to "appear" via phone. If he does not appear or have his request approved you just might win whatever you are asking for.

I am guessing your case is where you live and not where BF lives. Everytime I have been to court for custody stuff, everyone had to personally appear.

His atty was really pissed off and embarrassed that he didn't show. The judge ruled in my favor, but he probably would have regardless of ex showing up. You've done all you should have to do. It's your ex's responsibility to know what's going on in his child's custody case.

His mom told him that everything from now on was his responsibility and she wasn't going to help him anymore. knowing how he is he wont show.
