Neighbors from Hell!

Off subject but thought I would ask for help from you great people...

Since my divorce 4 years ago I've been living in these great apartment with wonderful neighbors. Two months ago this middle age couple(no kids) moved in below me and have been a nightmare since. First they have a very large dog that they allow to bark inside their apartment at all hours. Plus from the time they get home till the time they go to bed(after midnight some nights) they are banging doors,moving furniture, hammering etc.

Now it gets even better. About two weeks after they moved in I found a note taped to my door from them saying I walk to loud and can I vacuum when they are not home as it disturbs them. I was like WTF. I'm a single woman who goes to bed at 10pm every night how much noise can I make. Plus no one has ever complained about me before. Next week I vacuumed at my normal time 1pm on Sat and when I stopped they were banging on my door which I did not answer. After this I knew they were going to be a problem so I called my landlord and filled her in. She said they were being ridicules BUT stated they have been complaining about me saying I'm moving furniture all night (so not true). We ended it with she would call them to see what was going on.

Well since I complained their noise only got worse and its obvious they are doing it on purpose now. I need to have my tv,fan and white noise machine going to drown out most of their noise. BUT now they have started something new. At random times thruout the day AND night they will slam the bedroom door(which is right under my bedroom) with such force it rattles my windows, has pull picture frames off my wall and shakes my WHOLE apartment. If this happens when I'm sleeping it will wake me up with such a start my heart jumps into my chest. Everything else they do I can tolerate but this. Since I never know when they are going to do it I'm always on edge waiting.

Can anyone one offer advice with dealing with these @ssholes?

There is probably little else you or your landlord can do.

None of those behaviors is enough to call in the police for noise disturbance so you don't have a leg to stand on.

I have neighbors who work strange shifts so their "day" is typically during the night. They go out in the yard at 11 p.m. and stay out there until 6 a.m. LOUDLY talking, laughing, drinking, barbecuing, etc. This goes on at least five nights a week.

I've consulted the police and there is no noise ordinance they are violating since they don't blast music or use speakers. Same goes with dogs - as long as it isn't "nuisance" barking, they won't do anything about it.

Is there any way your landlord can come over for a while (and remain unseen by the other tenants)? That way she can witness the havoc they are engaged in herself.

I was a property manager for 10 years so I can try to give some advice but it really depends on city codes and management companies.
The management companies I worked for had a provision in the leases pertaining to 'quiet hours' which were usualy 9PM to 8AM.If any tenant was disturbing another during those hours then a written warning was then given.After 4 written warnings within a 12 month period the tenant in question could be evicted.

Its a tricky eviction though because if they fight it and it goes to court,a judge is most likely not going to rule to evict a family and make them homeless for what they would consider not being a big deal.

When I had situations come up like this one I would give the tenant being bothered a chance to transfer to another unit on the property but this is very inconvenient for them.I did have a couple of tenants take me up on it though and the noisy tenant seemed to simmer down and not bother their new neighbors so much.

It is a very irritating situation and I wish you the best.

I'd get the landlord involved. Then he/she can go over there and see what is causing all the chaos, and why the dog is barking so much. If the dog is being kept in questionable conditions, the landlord can help out. That would help the barking problem. It would also give the landlord a chance to warn them about a little thing called eviction.

Let the landlord know that they have escalated the noises since you initially complained. Tell the landlord that they are going to lose a long-time good tenant (YOU!) over these people. Mention that you have never had any other complaints against you until these bozos moved in.

Report them to the Humane Society or ASPCA and say that their dog is barking so much you think he is being neglected by them. }:)

We had neighbors who were so bad, that my ex husband and I had to sell our home years ago. We lived in a row home, which for those who do not know, is kind of like a condo. Anyway, it was very close, and the woman next store had 5 kids, who acted like wild animals. They would scream at all hours, and the cops were always there. Instead of taking the trash out, they would throw it out their 2nd story window, aiming at the trash can. They would usually miss, and the stuff would land on the ground and get pushed into our yard when it rained. Dirty diapers, used pads and tampons-absolutely disgusting. They would have huge groups of friends over, and there would be fights. The one daughter had different babies by different men who were usually in jail. It was horrible, and this was NOT a "bad" area.

The one thing I learned was to never say a word, but only after one day, I had enough, and I confronted the mother (her kids would scream obscenties at me and everyone else, among everything else). She flipped out, and thank goodness my ex was there, because he literally picked me up and took me in. She probably would have hit me.

There may not be much you can do. DO NOT get into any conversations with these people. Document everything, and please be careful, because they are probably harmless, but you never know.

It's obvious from the responses you've gotten so far that the landlord is your only enforcement tool so a long talk is in order with her. Most landlords will consider it a tenant vs tenant thing - no different that if property owners had problems with their neighbors. I.e. you work it out. But obviously give it a try.

One of our condo neighbors turned their HiFi (many years ago) towards their noisy neighbors wall, turned it up full blast and left the house. They came home hours later with ther electricity turned off. The fuse box was in front of the homes and theirs was not locked. They never had a problem again. We had a similar problem with out neighbor and did the same thing but just left it on for 10 minutes or so. I think our neighbor just didn't know how loud his was. He toned it down after that.

Escalating the noise level above theirs may have three consequences. First they've already demonistrated they're not afraid to be confrontational as they've been to your front door already. Me personally I would answer the door when they come up with my shotgun in hand but that's probably not your style. Fortunately they can't harm the outside of the apartment without getting in trouble with the landlord.

Second they may escalate their noise levels.

Third they'll tone it down when they get tired of being woke up by you. My response would be tit-for-tat. When they slam their door I set my alarm for one hour later and BAM my door gets slammed. Sliding closet doors are best used for this purpose. Often larger and heavier they make more noise and if your apartments has them that's probably what they're doing. You can't hurt them that easily so don't be afraid. Slide one door about 3 feet open and slam it shut using your body weight as well as the weight of the door. I.e. keep you hand on it all the way to the end of the slide. You'll probably scare yourself the first time. I assure you this is exactly what they are doing because a regular room door won't rattle walls upstairs to the degree you are describing. Unfortunately the sound won't travel down as easily as it travels up so really put your weight into it like they are. Practice a few times during the day when they're home so they'll know you're ready and able to fire back.

Many years ago I rented a condo from the owner (so it was not an apartment complex). It was a temporary home for me so I had very little stuff there.

My neighbors downstairs - but not directly below me complained that we walked too loud on the stairs (common stairs for 2nd and 3rd floor). Now we probably did walk too loud and I would gladly have tried to be quieter ......

But the stupid old couple below called the owner and made up all this crap that we played the stereo on high all night long, etc. I didn't even have a radio much less a stereo. I was on my computer and rarely even had the tv on.

I was so mad at all the lies that I just stomped after that. I know not very mature of me but it was many, many years ago.

Unfortunately I renewed my year lease the month they moved it(go figure) so if I break my lease and move early I'll be responsible for the remaining months(10).

I checked my lease and there is no mention of "quiet times". Weird I know. As far as the dog goes it ONLY barks when they are home so I know they get it to bark on purpose.

The retaliation answers were good. Its not normally my style but they are out of control. Like I said they are pissed I turned them in to the landlord and I won't do my vacuuming when they are not home so they are trying to harass me as much as they can with noise.

I tryed being as quiet as possible but it was not good enough for them so I may as well give them a taste of their own medicine. Now I know I can blast music or bang on the floors in the middle of the night BUT I don't want to be the one to be evicted. So that being said does anyone know what I can do to make noise that won't get me kicked out BUT a sure way to get back at this downstairs neighbor's?

I agree with Foxie's idea about the dog whistle. At 1am... 2am.... and then again at about 3am.... and so on and so forth. I think this is the best idea yet, because nobody will be able to PROVE you're doing anything. And I'm sure in the middle of the night, a loudly barking dog will be heard by many more tenants than just you.

I got the dog whistle but its not 'silent' like people think. Because of this I was afraid to blow it to long but did try it out but it did not cause the dog to bark. Don't know maybe its because the sound has to go thru the floor to the appartment below?? Has anyone every tryed a dog whisle? Do they work in making a dog bark and how close do you need to be for it to effect the dog?
