Twisted Triangulation and Taxes
As an addendum to my previous blog "Twisted Vines", I wanted to add the wonderfulness of the whole Toxic Troll wants half our child tax credit and NOW half our child stimulus payment.
Revealing note: I filed taxes Feb 15. No refund as of yet. No info on refund tracking. DH has received numerous texts asking for "her half".
I thought it would be nice to have a little extra, but honestly, even though we were generally receptive to the idea, shes been getting mean(er). Texting him "you go on fishing trips!" yeah we bought a boat "u go to concerts!" nope, its free music. Our friends. "you go out to dinners!" yeah we dutch it mostly. take turns.
Then the fun stuff :"child tax credit is $3,000 per child. Maybe cLove doesnt know what shes doing, although Im quite sure the computer does the calculation. Id like to see the child tax credit on your return. If it says $2,000, like you said, theres something wrong.
Theres also more child credit on top of stimulus..."
I said "feck that biotch, shes not seeing our return, feck that!"
I did a screen shot that clearly states that the child tax credit is currently $2,000. He sent it. And then she changed the tune to "well maybe thats another credit and u make too much money to get it...it was 3,000 2 years ago...when I claimed both kids I got $7,000."
SO, I made certain to tell him "no refund yet. Stimulus only".
So, now Im just fit be tied. I think Dh is FINALLY understanding. We do not want any contact. Even if it benefits us...and when she offered her ebt card and 50%, he said "nope". meaning nope to we pay $50 for $100 of groceries. Not unless hes buying me some good stuff...

Is DH court ordered to share
Is DH court ordered to share the tax credits with BM? If not, I'd say "Screw Off." I would also definitely tell her to screw off in regards to the stimulus payment.

YES, according to the current child support modification order, Toxic Troll IS given claiming rights, and its 51/49 for that purpose. HOWEVER, she signed the form "Form 8332, Release/Revocation of Release of Claim" because she doesnt work and hasnt paid any taxes. She didnt think she would get any $$$$$ so she didnt file tax return last year. But this year she did so she could get stimulus $$$$. So, yes she has cclaim rights by court order, but reliquished them, and now wants "her half", and she is assuming that it is the same tax credit as what she got 2 years ago, because I dont know what im doing. the amount is "something like 3,400 per child", but what she doesnt take into account is that there is also earned income credit for those making less than a certain amount. Its been $2,000 for a while.

BM let us take SD5 in 2019 and 2020 even though the CO provides for BM to take her. We agreed to give BM the child tax credit for SD5. The benefit to us of having SD5 as a dependent was greater than the $2000, so we happily handed that over. But the stimulus? No way, because BM and the Golden Goose wouldn't have gotten it even if they'd claimed SD5 for those years. The Golden Goose makes too much for them to qualify for stimulus, so we didn't even consider giving it to BM. To her credit, BM didn't even ask.

If it's not court ordered, you don't have to give her anything.
I put all the child stimulus in a college fund so that there wouldn't be any arguments over it and so far so good.

Seems to me that once she signed over the right to claim Munchkin to your DH, it was his right to claim her (and reap the benefits) until the Troll revokes it.

Problem is, if I remember correctly, OP's husband agreed to let bm claim the child every year.
Did your husband have her sign the form giving him claiming rights?
Perhaps it is time to have the order redrawn to alliw every other year claiming or at minimum, if she cant claim the credit due to no income, your dh can.

According to the child support modification order, Toxic Troll was given claiming rights. She signed Form 8332, Release/Revocation of Release of Claim. for 2019 and 2020. Because she did not pay any taxes, so she figures we did and she can get "her half" of the tax credit from taxes WE worked for and WE earned. See how that works out? Im $500 ahead and DH is $500 ahead and she gets $1,000.
And now the stimulus - she wants half that too. So another $700.

Just continue with your normal years taxes and ignore her.
Just like my SO has to to suck up the fact he let loser BM claims skids and she gets all the extra money. His fault. Oh well.

What's your tax arrangement? For the taxes just filed for 2020, the credit is still 2000. For 2021 the credit will be 3000, and they'll be sending half of it in monthly installments starting in (hopefully) July.
As far as the stimulus- if you guys claim her every other year both parents will end up getting it. If you claim her every year too bad for her.

ExH claims BS this year. I waited to file my taxes so I received the stimulus credit for him. ExH makes too much money to qualify for a stimulus anyways.
No I did not share it with him. Yes he pays CS but not a dime more for anything. He would never contribute to extracurricular activities or camps. What I get in CS truly only covers some of DS expenses. I also put some in an account in DS name for a car and college when he is older.

This is all your DH's fault, sorry. Not sure why he said he'd give her the refund at all. Still confused over that one. If I was you, I'd tell DH to deal with it himself and not involve me. Why should you suffer for your DH's decision over and over again?

She figures "hey THEY work, THEY pay taxes, THEY will get something back for kiddo, and I want my half".
He and I are just tired of her harrassment. She thinks its over $3,000 as well. But its $2,000. Told DH I must not know what Im doing...and she does. Forget about my work at CPA office doing tax returns...
