Well yet another milestone come and gone .. SS is 18 and roughly 50 weeks left of Child Support... SS called Hubby and said that “they” SS and Bio Beeatch were taking Hubby back for support in January. Funny huh?!? Times up! No paperwork so far.
So those that have terminated - do you go to court to emancipate fully?
Also anyone deal with skids nearly flunking high school So skids will be in school after age emancipation - Non Cust parent Have to keep paying child support on the loser?

I think it depends on what
I think it depends on what state and what the CO states. My DH's CO states that DH has to pay CS until the skids are the age of 18 or still in High School. Read up on what the law are in your state. In the state we will in my DH can contact the domestic relations office 45 days before the kid reaches the age of 18 to stop a CS order.
In OK you have to file for it
In OK you have to file for it to end after they graduate. Check with your local cs office.

I can only speak for Florida. One SD turned 18 in September. Child support ends at 18 unless you make provisions for it to extend while they are in highschool. It also ends at 18 if they are not expected to graduate before their 19th birthday. SO if they keep failing, it just ends at 18. So Oct 1'st, after SD had already turned 18 she filed for a child support increase. The court told her not only did she not get an increase but child support would be modified and was going down to the numbers for one child. They didn't say what the numbers were. She called and pitched and a fit and actually told me that the State told her she would have had to put it in her decree at the time of the divorce if she wanted it to continue while her child was in high school and she did not. I had never heard of that. So in December a deputy came to her house and made her sign papers saying her child support was going to decreased and she had a right to appeal. She has appealed and said she's going to ask the court to keep it the same while SD finishes her senior year. So the court date is in the middle of March. He'll have already paid the March payment. Graduation is in May. So I'm not sure if this was just a stall tactic so she gets to keep $1000 until May or if it will be retro'd to whatever the new amount will be as of the filing date of Oct 1st. In that case , well she could potentially only get $200 a month for SD16.5 who turns 17 in May.
SD16.5 is also failing school and basically not attending. I'm thinking she thinks this is going to extend her child support for another year but this is risky as SD's 18th birthday is mid May and here in Florida highschool graduation is end of May so she won't graduate by the time she turns 19. State law is state law so it will end regardless.
and in Florida, several months before highs chool graduation and the 18th birthdate, you are supposed to go and file the paperwork at the Courthouse for it to end.
