For those of you who have gone to court for school placement...

What is some of the documentation that was provided to the judge?

What factors did the judge consider and ask questions about during the hearing?

Did they ask for specific evidence for your arguments?

We have met with BM 3 times this summer and she is unwilling to budge, with her main concern being how it will effect her commute (4 miles further than the old school that now has a failing grade, and we are trying to get SD7 into our district now), we are off to court soon.

Any insight is appreciated!

ETA: SD lives with use every other week so both households are responsible 50% of the time.

Also were parents work schedules discussed as a factor in court?

Well that's good new as our school is the highest rated out of any of the ones BM has talked about! I have read other stories where the judge didn't put much weight on the grading system.

Courts like the status quo, so you'll have to prove how switching schools is in SD's best interest. The school rating is a good way to do that. Her grades and report card will probably factor in. For older kids, how socialized they are may factor in (extra curriculars and friends) since having to "start over" socially can be tough for kids. I'm not sure how much that will play into it if she's only going into second grade though. I don't think the courts care much about what's easiest for the parents, unless it would place an undue burden on the household. (For example, if your district wouldn't bus her to BM's and BM couldn't leave work early enough to pick her up in a timely manner.)

Grad rates are not going to be the best indicator for elementary school. (Do you really have public schools that go K-12, all in one school?? Nothing like that around here!) Look for ratings based on standardized testing, that will carry more weight.

Our main concern with the current school is the safety procedures are extremely disorganized and the school went from a B to an F over the last two years. SD has not struggled at all academically. We are hoping those problems would steer a judge from trying to keep the status quo when an alternative school is available for the child.
