Question in CS in Cali
If anyone has any insight, it's gratefully appreciated!
Thing 1 just graduated high school, and is 18. Their co doesn't require cs beyond hs. BM is paying CS as fdh is currently unemployed. She has not filed for modification (probably because she lied about her income, and if she goes back to court we'll demand tax returns. Gonna get ugly then). If she files in a few months, can she get the change implemented retroactive to the date Thing 1 aged out? I'm totally betting she'll just apply a modification herself and just send less $, and then we'll hit her with contempt and it'll go from there. But if she pays in full for now, and then tries to get it back, is that possible? If she could, then I'll get started building the nest egg to cover it stat.

There is a younger child, so support would continue but at a lower rate. With a child support review, based on the readings I have done, we can request tax returns to validate income. Could be wrong on that score, but that's what I've manage to glean from ca.gov readings.

That make sense. I suspect here it would be date of hs graduation, because kid turned 18 earlier in the school year and CS runs through 18 or end of hs, whichever is later.

I am in CA. In my case CS stopped once they graduated HS or turned 18. Two of my kids turned 18 while still in HS and Ex-H had to pay until they graduated. He prorated the last month using graduation date as the end of CS. My youngest turned 18 after graduation and he prorated the last month using his Bday as the end of CS. All of this done without court or any modification. We never had a CS order through the state child support office if that makes a difference?? There was an updated court order in 2008 when he tried to lower his CS payment and it increased again nothing through the state of CA child support office. So Ex-H stopped paying CS completely in 2012 when youngest turned 18.

Okay- I just have to ask this question. Why the HELL does one need approval to terminate support if the support order clearly states that it ends at 18/high school graduation?
