Wednesday she called the police, Thursday an emergency hearing!
Thank you to all who responded the other day. I realize now how silly it was that I even asked what we should do. I really appreciate all of you on this site and how you can make things so much clearer by giving the outside view. Here's how it played out...
So after DH got BM to admit she does not have a license on Tuesday night she still wanted to come over and show him her paperwork anyway. DH said fine, because we wanted to see just what the court order said, if she even had one.
Please give me some advice and opinions. BM has us in another tight spot.
So Bm was supposed to have her Occupational drivers license and the interlock device installed in her car before she could begin extended standard visitation with SD. Until then she had supervised visitation in our home three days a week. My stupid trusting self, took BM's word that she had her license when she showed me a reciept that she paid for it in November, and showed me the instruction manual to the interlock device. I am so STUPID!
We're having a baby! And BM lost it.
I guess after the last hearing in October we just kinda got on with living and it's been busy. We had some water damage in our bathroom and ended up remodeling completely, most of the work Dh and I did ourselves. Was having a little trouble getting things done while Dh was at work because I was so tired. I took two pregnancy tests before Thanksgiving, but I just couldn't believe it until we had the first sonogram last week. There's really a baby in there!

BM was over for her supervised visit yesterday.
I am just realizing how much this really does suck for her. Of course, she made her bed, but man! To have to beg family or friends for a ride to my home to visit with her own child must be tough to swallow. Dh got off work so he would be home and BM didn't like that at all. We think she was hoping it would just be her and I with SD because I am the nice one and she might be able to con me into allowing her alone time with SD.

Great news my friends!!!!
Our hearing was today and the judge appointed DH sole managing conservator and BM possessory conservator. BM is only allowed supervised visitation with SD in our home until she completes her requirements and obtains her occupational drivers license, then she is to have only extended standard possession until further order of the court.

Yes!!!!! We are no longer in contempt!!
After all the doubt our attorney planted, a judge did grant us an ex parte for extrodinary relief giving us SD until further order of the court. DH and I feel so much better that now we have proof that we are trying to do the right thing and it we will not be going into to the hearing on Monday in contempt.

Our attorney is driving me CRAZY!!!
Our attorney finally got it together enough yesterday to reset the hearing we missed Tuesday for Monday morning. But why the heck didn't get the restraining order or order for temporary possession or whatever he feels like calling it?!!! DH and I have been on him for a week that we want to get back to being legal in keeping SD, and a judge granted us a restraining order for us to keep SD when we felt like BM was going to put SD in danger by taking her to her abusive mother's house before.

I guess this is a stand off.
Well, here we are, in contempt. BM was supposed to get SD back on Monday. DH and I were condsidering keeping her because of our fears of what craxy BM would do or say when she found out about all the info we put in the petition for a change in temp orders, but BM kinda helped our decision when she text DH at 8:30pm on Sunday to say she was sending her ex-fiancee(whom 3yo SD hates) to pick her up on Monday. And no doubt, he was going to keep her all day too.

We did it, BM's criminal record and dirty myspace pics were filed in the courts on Wednesday.
I am feeling relieved, knowing that finally we have given all the information to the courts and it will be in the hands of the judge. I know there are no guarantees, but right now I feel we are really doing all that we can. I sat with our attorney for two hours on Tuesday and gave much input to get this petition to read just so.
BM's license is suspended because of her DWI. Would you let her pick SD up?
I got all the sentancing info and found that BM must have an Interlock system to get an occupational license to drive at all. Dh and I were pretty sure she didn't have an occupational license because she left her car at the daycare after she called the police last week.
When we picked SD up last night Dh looked in both of BM's cars (she has one that doesn't run because she let some guy drive when she had no ins. and he ruined the engine) and she doesn't have the Interlock breath thing in either one. Therefor, she does not have a licence to drive at all!
